''Morton v. Mancari'', , was a United States legal case about the constitutionality, under the Fifth Amendment, of hiring preferences given to Indians within the Bureau of Indian Affairs. The Supreme Court of the United States held that the hiring preferences given by the United States Congress were not violative of the Due Process Clause of the Fifth Amendment.
== Background ==
The appellees were a group of non-Indian employees of the Bureau of Indian Affairs (BIA). The Appellees brought this action claiming that the employment preference for qualified Indians in the BIA provided by the Indian Reorganization Act of 1934 also known as the Wheeler-Howard Act, 48 Stat. 984, contravened the anti-discrimination provisions of the Equal Employment Opportunities Act of 1972 and deprived them of property rights without due process of law in violation of the Fifth Amendment. The District Court held that the Indian preference was implicitly repealed by section 11 of the 1972 Act, which prohibited racial discrimination in most federal employment. The court enjoined appellant federal officials from implementing any Indian employment preferences in the BIA. The Supreme Court of the United States granted Certiorari.
